    WHAT THIS GUIDE IS (AND WHAT IT IS NOT)

    Most likely, if you’re reading this book, you’re either about to become a landlord, or you find yourself facing unexpected problems with a tenant. I hope this book will provide a good nuts-and-bolts understanding of the basics of evicting a tenant in Georgia. I, and my family, have been involved in all aspects of residential leasing for quite a while, and we find the business to be full of rewarding opportunity, but also full of pitfalls for those who don’t yet have the experience and knowledge to protect themselves. I do want, however, to set some ground-rules for this book so that you know what you’re getting into, and what to expect.

    Even though I am an attorney, I am not writing a law treatise here. I am not going to cover every technical aspect or argument under Georgia contract law and landlord-tenant law. I am simply putting together a simplified step-by-step guide to help you work your way through the process of evicting a problem-tenant on your own. I’m covering the basics only. After you read this guide, you will have the information and knowledge you need in order to file an eviction against a tenant based on non-payment of rent or other breaches of your lease. When I can, I try to include some sample forms for you to modify or tweak to fit your particular situation. If your particular situation is unusually complex, or involves issues not addressed in this book, please contact a landlord-tenant attorney for assistance. If you like, you may contact my office at info@kimandbagwell.com, and we’ll try to respond as quickly as possible. Hopefully, however, you will not need to hire an attorney for your simple eviction, and will be able to save that money or reinvest it into your real estate business.
