In the first part of the book, reference is made to the genesis of the CEPEJ Guidelines on Enforcement as well as to its state of application in the various Council of Europe Member States.
The second part of the book deals with the problem of the evolution of technologies and aims to question how artificial intelligence can be put at the service of enforcement. In this respect, the analysis focuses on the importance of both electronic access to information and access to dematerialised information, to highlight the imperative need for a procedure for seizure of dematerialised assets and to consider drafting the a crypto-currency attachment procedure.

Le 17 décembre 2009, la Commission européenne pour l’efficacité de la justice du Conseil de l’Europe a adopté des Lignes directrices pour une meilleure mise en œuvre de la recommandation existante du Conseil de l’Europe sur l’exécution. Ces principes visent à garantir à tous l’accès à un agent d’exécution et à une exécution de qualité dans le respect des droits fondamentaux des justiciables.
Dans la première partie de l’ouvrage il est fait état de la genèse des Lignes directrices de la CEPEJ sur l’exécution ainsi que de son état d’application au sein des différents États membres du Conseil de l’Europe.
La seconde partie de l’ouvrage aborde la problématique de l’évolution des technologies et vise à s’interroger sur la façon dont l’intelligence artificielle peut être mise au service de l’exécution. À cet égard, l’analyse porte sur l’importance tant d’un accès dématérialisé aux informations que d’un accès aux informations dématérialisées, pour relever l’impérieuse nécessité d’une procédure de saisie des avoirs dématérialisés et envisager l’ébauche d’une procédure de saisie des crypto-monnaies.

Marc Schmitz was born in 1970. He has been appointed as a judicial officer in 1996 and is acting since then in Saint-Vith, in the German speaking part of Belgium. Since 1997 he’s a member of the Permanent Council of the UIHJ as a delegate of the National Chamber of the Belgian Judicial Officers and he participated in the past on numerous colloquiums, seminars and conferences all over the world. He’s a member of the UIHJ board since 2012 and became its first Vice-President in 2015. Since May 2018, he’s the President of the UIHJ.

Marc Schmitz est né en 1970. Il a été nommé comme huissier de justice en 1996 et instrumente depuis lors à Saint-Vith, en région germanophone de la Belgique. Il fait partie depuis 1997 du Conseil permanent de l’UIHJ en tant que délégué de la Chambre nationale des huissiers de justice belges et a participé depuis lors à de nombreux colloques, séminaires et conférences dans le monde entier. Il est membre du bureau de l’UIHJ depuis 2012 et est devenu son premier vice-président en 2015. Depuis mai 2018, il est le président de l’UIHJ.

Patrick Gielen is a Belgian judicial officer since 2013. He has been working in this capacity since 2017 within the Modero Belgium structure. He is advisor to the President of the International Union of Judicial Officers and special international advisor to the National Chamber of Judicial Officers of Belgium. Since 2018, he has also been President of the French-speaking Belgian appointment Commission of the Judicial Officers and member of the editorial board of the Belgian magazine "L’huissier de justice". He is a specialist in European civil procedure and has participated in numerous colloquia and written numerous articles and legal books.

Patrick Gielen est huissier de justice belge depuis 2013. Il exerce en cette qualité depuis 2017 au sein de la structure Modero Belgique. Il est conseiller du président de l’Union internationale des huissiers de justice et conseiller spécial international auprès de la Chambre nationale des huissiers de justice de Belgique. Il est également depuis 2018 président de la Commission de nomination francophone belge des huissiers de justice et membre du comité de rédaction de la revue belge « L’huissier de justice ». Il est spécialiste de la procédure civile européenne, a participé à de nombreux colloques et a rédigé de nombreux articles et ouvrages juridiques.
Ramin GURBANOV (Azerbaïdjan)

Ramin Gurbanov, Judge, Baku City Yasamal District Court, is President of the CEPEJ since 2018. He has been a member of the CEPEJ since 2005, a member of the Bureau since January 2015, a member of the Working Group on Evaluation since 2010 and Vice-President of the CEPEJ since 1st July 2016. Various CEPEJ publications can be counted amongst the works published by Mr Gurbanov in the field of international, European and criminal law.

Ramin Gurbanov, juge à Baku City, Yasamal District Court, est président de la CEPEJ depuis 2018. Il est membre de la CEPEJ depuis 2005, membre du Bureau depuis janvier 2015, membre du Groupe de travail sur l’évaluation depuis 2010 et vice-président de la CEPEJ depuis 1er juillet 2016. Parmi les ouvrages publiés en matière de droit international, européen et pénal, l’un recense les diverses publications de la CEPEJ.

Mathieu Chardon is a French judicial officer, currently First Vice-President of the International Union of Judicial Officers. He has worked as a judicial officer since 1993. Trainer at the National School of Procedure of France (ENP), since 1995, he joined in 1999 the International Unit of the ENP, then the International Union of Judicial Officers in 2001. He has since participated in numerous expert missions for the Council of Europe and the CEPEJ, as well as a multitude of international conferences and seminars in some fifty countries. He is a member of the CEPEJ Working Group on Enforcement (CEPEJ-GT-EXE) and participated in the writing of the CEPEJ Guidelines on Enforcement of 17 December 2009. He has written several reports for the Council of Europe and the CEPEJ, as well as many legal works and articles.

Mathieu Chardon est un huissier de justice français, actuellement premier vice-président de l’Union internationale des huissiers de justice. Il exerce en qualité d’huissier de justice depuis 1993. Formateur à l’École nationale de procédure de France (ENP), depuis 1995, il intègre en 1999 la cellule internationale de l’ENP, puis l’Union internationale des huissiers de justice en 2001. Il participe depuis à de nombreuses missions d’expertise pour le Conseil de l’Europe et la CEPEJ, ainsi qu’à une multitude de colloques et séminaires internationaux dans une cinquantaine de pays. Il est membre du groupe de travail de la CEPEJ sur l’exécution (CEPEJ-GT-EXE) et a participé à l’écriture des Lignes directrices de la CEPEJ sur l’exécution du 17 décembre 2009. Il a rédigé plusieurs rapports pour le Conseil de l’Europe et la CEPEJ, ainsi que de nombreux articles et ouvrages juridiques.
Guillaume PAYAN (France)

Guillaume Payan is an HDR Lecturer at the University of Toulon (France), where he directs the Master 1 and Master 2 degrees in Justice, Trials and Procedures, with a specialization in Judicial Litigation. He is Deputy Dean in charge of student life, internships and professional integration at the Faculty of Law of his University. Author of several books and numerous articles in private judicial law and in the law of the European Civil Judicial Area, he has notably written his doctoral thesis on the subject of European enforcement law in civil and commercial matters. Guillaume Payan est maître de conférences HDR à l’Université de Toulon (France), où il dirige les diplômes de master 1 et de master 2 Justice, Procès et Procédures, mention Contentieux judiciaire. Il est vice-doyen délégué à la vie étudiante, aux stages et à l’insertion professionnelle de la Faculté de droit de son université. Yannick Meneceur is a magistrate of the French judiciary, seconded to the Council of Europe, assigned as an advisor in digital transformation and artificial intelligence. He is also an associate researcher at the IHEJ (Institut des hautes études sur la justice). He has held criminal functions, particularly in the fight against cybercrime and counterfeiting. At the Council of Europe, he contributed to the comparative analysis of European judicial systems. A former student of the IRA in Lille (analyst qualification), he was responsible for leading a major national IT project in France and developed expertise in digital transformation, particularly with regard to the regulation of artificial intelligence. He is an occasional speaker at the ENM and ENA and is also a member of the scientific councils of the digital centers of the Club des juristes and the PRESAJE Institute.

João Arsénio de Oliveira is the Head of Department of the Office for International Affairs of the Portuguese Ministry of Justice and the Deputy Secretary-General of the Conference of Ministers of Justice of the Portuguese Speaking Countries (CMJPLOP). He is the Portuguese delegate at the European Commission for the Efficiency of Justice (CEPEJ) since 2004 and is currently Chairman of its Working Group on Quality of Justice (CEPEJ-GT-QUAL). At the Council of Europe, he is also Vice-Chairman of the Steering Committee on Legal Co-operation (CDCJ). He was legal adviser to the Minister of Foreign Affairs. He has been working in international legal affairs for about two decades, namely with the European Union, the United Nations, the OECD and the Hague Conference on Private International Law. He completed his master’s degree in Law of the European Union.

João Arsénio de Oliveira est chef de département du Bureau des affaires internationales du ministère portugais de la Justice et secrétaire général adjoint de la Conférence des ministres de la Justice des pays lusophones (CMJPLOP). Il est le délégué portugais à la Commission européenne pour l’efficacité de la justice (CEPEJ) depuis 2004 et est actuellement président de son groupe de travail sur la qualité de la justice (CEPEJ-GT-QUAL). Au Conseil de l’Europe, il est également vice-président du Comité directeur pour la coopération juridique (CDCJ). Il a été conseiller juridique du ministre des Affaires étrangères. Il travaille dans le domaine des affaires juridiques internationales depuis une vingtaine d’années, notamment au sein de l’Union européenne, des Nations unies, de l’OCDE et de la Conférence de La Haye de droit international privé. Il est titulaire d’une maîtrise en droit de l’Union européenne.

She specializes in civil procedure, civil enforcement proceedings and European human rights law, matters in which she has published extensively. She is a member of the editorial boards and scientific councils of several journals. She holds numerous positions in the field of international civil justice (she is an independent expert at the Council of Europe since 2002; member of the Pedagogical Committee of the International School of Amicable Dispute Resolution of the Paris Bar since 2017) and national (she is a member of the Scientific Council of the International Union of Judicial Officers; Director of the Mediators’ Law and Ethics Unit at the IFOMENE Mediators’ Training Institute; President of the National Commission for the Examination of Access to the Lawyers’ Professional Training Centre since January 2017; member of the Higher Council of the Judiciary since February 2019).
