Given the gravity of the consequences, the legal process is meticulously thorough to ensure justice is served.Scrutiny and Due Process: The Constitution guarantees due process for all individuals, but the stakes are especially high in capital cases. Every aspect of the trial, from jury selection to evidence presentation to sentencing, undergoes intense scrutiny to minimize the risk of error and ensure fairness.Special Legal Procedures: Capital cases often involve specialized legal procedures that aren't present in other criminal trials. For instance, jury selection may be more rigorous, and there may be separate sentencing phases where jurors must weigh aggravating and mitigating factors.Complex Evidence and Witnesses: Capital cases frequently involve complex evidence such as forensic analysis, expert testimony, and multiple witnesses. Sorting through this evidence and presenting it in a clear and understandable manner to the jury takes time.Appeals Process: Capital cases are more likely to be appealed due to their severity.
